SAN DIEGO — In light of the recent revelations about commissioner Marquez’ residency – on top of his already documented partisan leanings – Chairman Tony Krvaric will call on Mr. Marquez to resign at the commission hearing this afternoon.
“After learning about Mr. Marquez taking a job in Los Angeles, the Republican Party of San Diego County hired a private investigator to establish Mr. Marquez’ true residency, and in fact it is now without question in our mind that he does not live in San Diego.”
“A Los Angeles resident should not be deciding the district lines that actual San Diego residents will have to live with for the next ten years. Mr. Marquez should do the honorable thing and resign at tonight’s meeting. We will publicly be calling for him to do so.”
“San Diegans regardless of party affiliation deserve better than to have hyper-partisans – who don’t even live in the city – meddling with their council district lines. If Mr. Marquez truly wants what’s best for San Diego, he will resign effective immediately tonight.”

OK…not a laywer but I did stay at a Holiday Inn…..
As I read the election code, if Mr. Marquez is living in LA he can’t remain registered in San Diego. If he is, isn’t it ELECTORAL FRAUD? Shouldn’t someone be telling him that he is risking jail? Or am I misreading the election code (and not looking at case law) when it comes to “domicile”?

If you have residences in two different cities, is it legal to be registered to vote in either one?
Alger, owning or renting abodes is NOT the same as RESIDING in such structures. Sorry you don’t grasp the distinction.
The courts do, however. Well, at least they are SUPPOSED to. So do the taxing authorities.
Try renting a home in Nevada, living in CA and claiming you don’t own CA income tax because you choose to call Nevada your home (which it ain’t). Good luck with that!

What is it about Alger’s comments on this blog that result in such curiously toxic responses? It seems to us that Alger asked a legitimate question. In fact, he didn’t even share an opinion.
Now, it could be that readers may surmise an opinion implied by the question, maybe based on Alger’s past comments here, but it still stands as a pretty simple question.
If I reside in San Diego about half the year and in Tahoe the other half (many people do indeed do that sort of thing), can I CHOOSE at which residence to register to vote on a permanent basis? How about a 75 percent vs. 25 percent of the time scenario?
The courts have weighed in over the years on this matter when it comes to candidates and public officials, including the question of temporary residences for jobs and the such.
Would someone care to attempt an answer based on current codes and case law?
No, I think it is you that do not realize that someone could actually live (reside) part-time in more than one residence.
I would suppose you are ok with our elected officials being registered to vote in their home districts even if they actually lived mostly in Sacramento or Washington D.C.

Both. As well as early and often. Thor and I are permanent mail voters. He does fill out my ballot for me, but I brush the tangles out of his hair.
A bunch of this is laid out in mind numbing detail in the state election code. It runs about 4 pages and I have neither the direct interest nor time to slog through it.
But on its surface it would seem to preclude counting san diego your domicile and keeping your registration if by that it means you are couch surfing 1 night a week and spending 6 in west hollywood. It isn’t clear, from what I can tell, how you handle 6 months one place and 6 months another. 9 months vs. 3 would suggest you register in the place you are the longest.
The argument I’m hearing from the pro-Marquez side is that he was registered to vote in San Diego at the time of his appointment, which according to them is the technical requirement. Where he is registered now, or is supposed to be registered now depending on the Registrar’s requirements, does not change the fact that at the time of his appointment he was registered in San Diego. To me that’s a load of BS.
If he has in fact moved to LA, and is not eligible to be considered a voter in San Diego, then while he technically may qualify, he certainly is violating the spirit of the requirements for being a San Diego Redistricting Commissioner. A non-San Diegan should not be involved in drawing district boundaries for the city of San Diego — that certainly was the intent of the requirements.
Hopefully the GOP hires an attorney who understands all this stuff a lot better than I do and puts the heat on Marquez — and the appointing judges as well, if need be.
