Looks like Bob Filner didn’t do himself any favors with today’s press conference, contradicting himself and making statements which are now being proven wrong. This man is a train wreck!
Here’s a timeline of stories breaking this afternoon…
3:15 pm today Filner throws Allen Jones under the bus:
U-T San Diego: “Filner Returns Developer’s $100k – Mayor Says He Didn’t Know There Were Strings Attached”
Take a look at the damning PDF of the Memo outlining the $100k payment in return for the mayor lifting his veto of the project.
at 5:20 pm the U-T reaches Allen Jones who fires back:
U-T San Diego: “Aide Says Filner Knew Donation’s Purpose – Mayor Was Aware $100,000 Was Connected To Project Approval, Jones Says”
at 5:49 pm even the liberal Voice of San Diego catches on, filing TWO stories:
Voice of San Diego: “Departed Mayoral Aide Stands By Sunroad Deal, Says Mayor Guided It”
Voice of San Diego: “Mayor’s Former Aide Describes A Humiliating Work Environment”
…and I can only imagine what the television news will have to say on the subject tonight! This is unbelievable! As they say… DEVELOPING!

The memo (link above) is not a memo … it’s a CONTRACT. There is an offer and acceptance, mutual agreement, consideration for established value, a writing (for property rights) and signatures. Contrary to law, there was no assessment done for the property right purchased from the City, and no City Council or City Attorney approval.
The Mayor knew this was an illegal contract, as he did the exact same thing in the TMD shakedown, which was litigated by the Mayor’s own attorney.
The Strong Mayor sets the Policy direction of the City of San Diego.
The City Council with the political help of City Attorney Jan Goldsmith and the former Development Service Department (DSD) voted twice to gift the private Sunroad Corporation a 9 foot easement instead of selling the public land for fair market value.
Where is the Outrage?
In an abundance of caution, even through the City Attorney stated the money could legally be placed in the General Fund, Mayor Filner instead returned the $100,000 check to Sunroad.

If the City Council and City Attorney wants closure on the Sunroad issue, the item should be brought back before the City Council, in according with guidelines and recommendations made City Attorney Jan Goldsmith in his Legal Memorandum on the matter of sales of public land to Sunraod . Note the Legal Memorandum did not include the ability to GIFT public lands pushed through by Lori Zaft and the City Attorney.
