In a 12:30 pm interview today, KOGO talk host LaDona Harvey learned that attorneys for Marine Sgt. Gary Stein will now amend their Federal suit to “stay” further processing of the Marine’s discharge pending his appeal to the 9th Circuit U.S. Court of Appeals. San Diego attorney Gary Kreep told Harvey that Stein is still a Marine, but his status needs to be preserved to protect his civil rights in court. Kreep said media reports that Stein has already been “thrown out” of the Corps are wrong. Sgt. Stein is singled-out for criticizing President Obama’s policies. Earlier SD Rostra coverage of the story is here. Marine officials today announced they plan to discharge Stein, costing him 9 years of earned benefits, including a tour of service in Iraq.
